Official Rules
The 2027 TA Citizen Driver® Contest (“Contest”) seeks to recognize over-the-road professional truck drivers who evoke public respect for the truck-driving profession.
- NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR ABILITY TO WIN.
- VOID WHERE PROHIBITED BY LAW.
- ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE CONTEST, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE CONTEST PARTIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
1. ELIGIBILITY: The eligibility for participation in this Contest is as follows:
A. Nominator Eligibility: To submit a nomination, you must be a legal resident of the fifty (50) United States or District of Columbia who is eighteen (18) years of age or older at the time of participation (each, a “Nominator”). Nominators may not be employees, directors, or officers of TA Operating LLC (the "Sponsor"), BP Products North America Inc., Realtime Media LLC (the “Administrator”) or any of their respective parent companies, affiliates, subsidiaries, and advertising, contest, fulfillment and marketing agencies (collectively, the “Contest Parties”), their immediate families (spouse, parent, child, sibling, grandparent, and spouse and "step" of each) and members of the same household of each, however employees of Sponsor’s TA®, TA Express®, and Petro Stopping Centers® branded retail locations who are otherwise eligible may be Nominators. For purposes of this Contest, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and their respective spouses, and those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not. The Contest is void where prohibited by law.
B. Nominee Eligibility: To be considered an eligible Nominee (as further defined below), at time of nomination and promotion period, if selected as winner, you must: (i) be a licensed over-the-road professional truck driver; (ii) be currently employed as an over-the-road professional truck driver or actively driving as an over-the-road professional truck driver as an owner or in an independent contractor capacity; (iii) not have been issued any tickets or moving violations in the past five (5) years; (iv) be 21 years of age or older and be a legal resident of the fifty (50) United States or the District of Columbia; (v) never have been arrested, charged, or convicted of a misdemeanor or felony; (vi) have no unresolved tax liens and have not filed for bankruptcy in the last ten (10) years; (vii) have no offensive and/or seemingly-threatening social media posts or profile/bio (in Sponsor’s sole discretion); and (viii) be a registered member of the earnify™pro loyalty program (“Program”). Program registration and membership are free. To apply for Program membership, visit a kiosk at any TA®, TA Express® or Petro Stopping Centers® location, or apply online at https://www.ta-petro.com/professional-drivers/earnifypro/. A husband/wife owner/operator team may be a Nominee, provided both members meet the eligibility requirements set forth herein.
Void where prohibited by law. All federal, state, and local laws and regulations apply. By participating in the Contest as a Nominator or Nominee, you unconditionally accept and agree to comply with and abide by these “Official Rules” and the decisions of Sponsor, including the interpretation of these Official Rules, administration of the Contest, selection of winners, and Sponsor’s exercise of discretion, which will be final, non-appealable, and binding in all respects.
2. TIMING: The Contest entry period begins at or about 8:00 a.m. Eastern Time (“ET”) on August 10, 2026 and ends at 11:59:59 p.m. ET on October 5, 2026 (the “Entry Period”). A “Judging Period” will begin on October 6, 2026 and end on or about December 18, 2026. The Entry Period and Judging Period are collectively referred to as the “Contest Period.” The designated computer clock of the Administrator is the official time-keeping device in the Contest.
3. HOW TO PARTICIPATE: All Nominators must meet the eligibility requirements set forth above for Nominators. Be sure to only submit nominations of a long haul-truck driver (or a husband/wife owner/operator team) that meet all the eligibility requirements set forth above (a “Nominee”). You may submit a nomination on behalf of yourself, provided you meet the eligibility requirements set forth above for a Nominee. To participate in the Contest, you must complete the following steps:
A. Submit a Nomination: There are two (2) ways to submit a nomination in this Contest during the Entry Period:
i. Online: To submit a nomination online, visit https://www.citizendriveraward.com/ (the “Website”) and follow the on-screen links to fully and accurately complete the “Nomination Form”, including Nominee’s Full Name, Nominee’s Phone Number, Nominee’s Email, Nominee’s Driving History and, if nominating someone else, your (Nominator’s) Full Name, Relationship to Nominee, Email, and Phone Number. Then, whether for yourself or a different Nominee, answer the open-field questions of up to 1,500 characters about Nominee’s Citizenship, Safety, Community Involvement, Leadership, and Health & Wellness. Collectively the Nomination Form and open-field answers are your “Nomination” and is subject to the limit below.
ii. Mail A Nomination Form: If you are unable to submit a Nomination online at the Website, first, email TACitizenDriverContest@promosupport.com to request a PDF of the nomination form. Then, complete the Nomination Form and open-field answers, as set forth above, and mail a printed copy of the Nomination Form to Realtime Media, Attn: 2027 TA Citizen Driver® Contest Entry (11530), 2460 General Armistead Ave STE 209, West Norriton, PA 19403. Your Nomination must be postmarked by October 5, 2026, and received by October 12, 2026, to be considered in this Contest.
Nominees must meet all eligibility requirements as set forth herein, and the materials submitted as part of the Nomination must be fully completed for the Nominee to be considered eligible (each an “Eligible Nominee”). All Nominations submitted online must be received by 11:59:59 p.m. ET on October 5, 2026, and all Nominations mailed must be postmarked and received by the dates specified above. Nominations become the property of Sponsor and will not be returned and may not be acknowledged, except by the Notice of Nomination as set forth below. Proof of submission will not be deemed to be proof of receipt.
B. Nominee Confirmation & Background Check: Eligible Nominees will receive confirmation of Nomination, along with a link to the complete Official Rules and a background check authorization via email to the email address submitted on the Nomination Form (the “Notice of Nomination” email). Regardless of how a Nomination was submitted, upon receipt of the Notice of Nomination, each Eligible Nominee will be asked to confirm their agreement to proceed in this Contest. Eligible Nominees will be required to submit to, and cooperate in, a confidential background check to confirm eligibility and to help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on the Contest or the Sponsor as determined by Sponsor in its sole discretion.
By agreeing to allow a Nomination to proceed for consideration by the judges, including agreeing to a background check as a condition to further participate and receive consideration in this Contest, Eligible Nominees must fully and unconditionally agree to be bound by these Official Rules and the decisions of Sponsor, which will be final and binding in all matters relating to the Contest. Eligible Nominees understand and agree that Sponsor may disqualify them if they fail to consent to a background check or based on the results of the background check, at Sponsor’s sole discretion. For husband/wife owner/operator teams, both individuals must submit to and pass the background check for the team to qualify and/or move forward in the Contest (one team member may not move forward without the other). If you do not wish to have your Nomination considered further, please email TACitizenDriverContest@promosupport.com to opt-out of the Contest within twenty (20) days of receipt of Notice of Nomination. Failure to return the background check authorization as required will result in forfeiture of the opportunity to move forward in the Contest, and such Eligible Nominee will be removed from further consideration in the Contest. Eligible Nominees who pass the background check, as solely determined by Sponsor, will be deemed “Semi Finalists,” and shall proceed to the Judging Period of the Contest.
C. Nomination Limits & Other Requirements: Each Nominator may only submit one (1) Nomination during the entire Entry Period. If the same Nominee (or husband/wife owner/operator team) is nominated by more than one (1) Nominator, all Nominations for that Nominee (or husband/wife owner/operator team) will be combined and judged together. Attempts made by any individual to submit Nominations in excess of the stated limit by using multiple or false contact information, accounts or otherwise may result in disqualification. Nominations generated by script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Nominations that are in excess of the stated limit, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Contest at Sponsor’s sole and absolute discretion. Those who do not follow all instructions, provide the required information in their Nomination Form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. Nominations submitted by those who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. In the event of a dispute over the identity of a Nominator or Nominee, Nomination will be deemed submitted by/for the registered account holder of the email address associated with the Nominator/Nominee (as applicable) as submitted on the Nomination Form, provided that person is eligible. Any potential winner may be required to show proof of being the registered account holder. Registered account holder is defined as the person assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses. In the event that a dispute regarding the identity of the individual who submitted a Nomination, or the intended Nominee, cannot be resolved to Sponsor’s satisfaction, the affected Nomination will be deemed ineligible.
You agree that you will not use the information included in any Nomination for any other purpose, including, without limitation, posting the Nomination to any online social networks, without the express consent of Sponsor in each instance.
By submitting a Nomination, you represent and warrant that the work submitted is original to you and that neither it nor its contents infringe upon or violate the rights of any third party. Nominations may not defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights.
By submitting Nomination, you acknowledge and agree that Sponsor may receive other Nominations under this Contest that may be similar or identical to the Nomination submitted by you, and you waive any and all claims you may have had, may have, and/or may have in the future, that any other Nomination reviewed and/or used by Sponsor may be similar to your Nomination and you understand that you will not be entitled to any compensation because of Sponsor’s use of such other similar or identical material.
4. JUDGING AND SELECTION OF FINALISTS: Administrator will review the nominations of all Eligible Nominees and evaluate the Nomination of each, giving equal weight (fifty percent [50%] each) to the following two judging categories (the “Judging Categories”): (i) the Nominee’s safe driving record (“Safety Record”) and (ii) the Nominee’s character based on citizenship, community involvement, leadership, health & wellness and/or other significant life experiences as reflected in the information provided in the nomination (“Citizen Driver Categories”). The ten (10) Eligible Nominees with the highest combined scores in the Judging Categories will each be named the “Finalists.” If there is a tie in determining the Finalists, the tied individuals will be re-evaluated by the judges and ranked on their Safety Record and the Nominee who has the higher ranking will win the tiebreaker.
5. WINNER SELECTION, NOTIFICATION, AND VERIFICATION: Finalists will be notified by Administrator and will be asked to submit up to eight (8) letters of recommendation/testimonials and copies of any awards they have received and any photographs they wish to share in support of their nomination (“Nominee Supporting Information”) within approximately 7 to 10 days. All details and deadlines will be provided at the time of the notification. The nominations along with any Nominee Supporting Information submitted by the Nominee will be combined to form a “Nominee Dossier,” for each Finalist which will be sent to a panel of judges, comprised of trucking industry experts, for final judging based on overall impression of the Finalist to be a top representative of the over-the-road trucking industry, based on all information available. Up to two (2) ranking Finalists will be named the “Grand Prize Winners,” subject to verification by the Sponsor; but depending on the caliber of Finalists (in Sponsor’s sole discretion) Sponsor reserves the right, but not the obligation, to name up to an additional four (4) Grand Prize Winners, based on ranking. If there is a tie in the ranking of the Finalists to determine the Grand Prize Winners, the tie will be broken by Sponsor based on Sponsor’s determination of which tied Finalist has a more compelling story as reflected in the Citizen Driver Categories. See Notification and Verification Section below. The verified Grand Prize Winners will be invited to attend an Award Ceremony sometime in March 2027, at a location specified by the Sponsor (the “Award Ceremony”) where they will be presented on stage. Grand Prize Winners will be officially notified by email on or about January 12, 2027 and may also receive a congratulatory phone call notification. Sponsor reserves the right to select fewer than the stated number of Finalists and/or Grand Prize Winners if, in its sole discretion, it does not receive a sufficient number of qualifying Nominations. No more than the stated number of prizes will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected either via the judging process described above from among all persons making purportedly valid claims for such prize(s). Inclusion in such process shall be each Eligible Nominee’s sole and exclusive remedy under such circumstances. The Contest Parties are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners.
6. PRIZES: Prizes are awarded to the Nominees. There is no prize for Nominators.
Finalist Prizes (10): Each “Finalist Prize” is 10,000 earnify™pro points, terms and conditions apply. The approximate retail value (“ARV”) of each Finalist Prize is $100.00.
Up to Two (2) Grand Prizes: In addition to the prizes already received as a Finalist, each “Grand Prize” Winner will also be awarded the following:
- A marker with Grand Prize Winner’s name on it at or within a participating TA®, TA Express®, or Petro Stopping Center® (location determined by Sponsor, in its sole discretion) dedicating that TA®, TA Express®, or Petro Stopping Center® to the applicable Grand Prize Winner for a period of time to be determined by Sponsor in its sole discretion (the type of marker and placement of the marker is in Sponsor’s sole discretion and is subject to local zoning laws, space availability and other factors which may be within or outside Sponsor’s control);
- 10,000 additional earnify™pro points, terms and conditions apply;
- Winner’s choice of either a $750 travel voucher to attend the Award Ceremony or economy-class air transportation for the Grand Prize Winner and one (1) travel companion to attend the Award Ceremony from a gateway airport near winner’s home, all details determined by Sponsor, in its sole discretion;
- $250 that may be used for travel expenses (awarded in the form of a check drawn on US funds) for attendance at Award Ceremony;
- Double occupancy standard hotel accommodation for Grand Prize Winner and one (1) travel companion for two (2) nights, coinciding with the Award Ceremony;
- $5,000 (awarded in the form of a check drawn on US funds) to the Grand Prize Winner;
- $2,500 donation to the Grand Prize Winner’s selected organization, limited to either Saint Christopher Truckers Relief Fund (SCF) or Truckers Against Trafficking (TAT), subject to Sponsor approval;
- Honored live on stage at the Award Ceremony;
- Dedication Ceremony for Grand Prize Winner and up to thirty (30) guests at the TA®, TA Express®, or Petro Stopping Center® dedicated in honor of Grand Prize Winner on a date determined by Sponsor in its sole discretion, taking into account Grand Prize Winner’s schedule and preference, as possible. Grand Prize Winner, travel companion, and guests are responsible for all travel costs and accommodations, if applicable, associated with attending the Dedication Ceremony.
The ARV of each Grand Prize (donation not included): $6,350.00.
Total ARV of all Prizes in this Contest is at least $13,700 (the value of the Finalists and two (2) Grand Prizes combined).
Each Grand Prize Winner will be provided with a list of available TA, TA Express and Petro Stopping Centers and asked to list five (5) available TA, TA Express and Petro Stopping Centers they might like dedicated in their honor (1-5 in order of preference) and Sponsor will select one of those travel centers in its sole discretion, if available, to dedicate to said Grand Prize Winner with a marker identifying said Grand Prize Winner of Sponsor’s choosing. A travel center shall remain dedicated in honor of a Grand Prize Winner for a period of time to be determined by Sponsor in its sole discretion. Sponsor may remove a Grand Prize Winner’s historical marker and/or dedication from the designated travel center at any time, for any reason, in Sponsor’s sole discretion. Sponsor may remove a Grand Prize Winner’s historical marker and/or signage from the designated travel center due to any action or conduct by a Grand Prize Winner (including past or present action or conduct) that is illegal, immoral or in any way negatively affects the Sponsor’s image by virtue of the association between a Grand Prize Winner and Sponsor, as determined by Sponsor’s sole discretion, as well as if a Grand Prize Winner endorses or otherwise becomes affiliated publicly with any competitor of the Sponsor. This element of the prize has no cash value, and no Grand Prize Winner will be entitled to any compensation if his/her marker and/or dedication is removed from a travel center. A travel center that has been dedicated to the winner of a previous Citizen Driver contest is not considered to be an available travel center, unless otherwise determined by Sponsor.
Grand Prize winners are not required to attend the Award Ceremony to receive the Grand Prize, however in the event a Grand Prize winner chooses not to attend the Award Ceremony, the portions of the Grand Prize relating to travel to the Award Ceremony will be forfeited, with no further obligation to the Grand Prize winner. In the event the Award Ceremony does not or cannot take place for any reason, Sponsor will award the remaining elements of the Grand Prize, with no further obligation to the Grand Prize winner.
Prizes are non-transferable (if a Nominee becomes disqualified due to a change in eligibility, including if he/she is deceased at the time a prize is to be awarded, the prize will be forfeited). No substitutions or cash redemptions will be made at request of any winner; however, Sponsor reserves the right to substitute a prize of comparable or greater value if prize, or portion of prize, becomes unavailable. earnify™pro Points are subject to the applicable Program rules available at https://www.ta-petro.com/professional-drivers/earnifypro/. All taxes on prizes are the sole responsibility of the winners. Unclaimed prizes will not be awarded. Limit of one (1) Finalist Prize and one (1) Grand Prize per person.
7. NOTIFICATION AND VERIFICATION: All potential Finalists and Grand Prize Winner(s) will be officially notified via email and/or phone (the “Winner Notification”), and prizes will be awarded either electronically or by mail following winner verification. Depending on the potential winner’s prize level, the Winner Notification may include a Declaration of Eligibility/Confidentiality form/Liability and Publicity Release, confirming understanding, acceptance and compliance with these Official Rules, acceptance of the prize(s) as offered and a release releasing Contest Parties with respect to any and all injuries, accidents, loss or misfortunes related to the conduct of the Contest, awarding of any prize(s), travel to and from and participation in any prize-related activity, and any use and enjoyment of the awarded prize(s). The travel companion of a Grand Prize Winner may not be a minor unless Grand Prize Winner is said minor’s parent or legal guardian. Each travel companion of a Grand Prize Winner must also sign a Liability and Publicity Release before travel arrangements are booked, or prize(s) may be forfeited. All form(s) listed above must be signed and returned within ten (10) days from postmark date on Winner Notification, or prize(s) may be forfeited. If a potential winner is found to be ineligible, declines to accept the prize(s), or if a Winner Notification, a prize confirmation, or prize is returned undeliverable, the potential winner will be disqualified, his/her prize(s) will be forfeited and, at the Sponsor’s sole discretion, prize(s) may be awarded to an alternate winner using the judging process described above, or the applicable prize may go un-awarded. Potential winners may be required to furnish proof of identification. Grand Prize Winners may be required to provide valid credit card at hotel check-in to cover any hotel incidentals and damages. Grand Prize Winners are responsible for any expenses associated with prize and travel not specifically set forth herein as being covered by Sponsor.
Each Potential Grand Prize Winner must complete a W9 form before receiving the prize. If the W9 form is not signed and returned within ten (10) days from the send date, the Grand Prize Winner forfeits said prize and an alternate potential winner may be selected. Grand Prize Winner(s) will receive a 1099 tax form at the end of that year for the total value of the prizes received. Nominees/Finalists agree to keep their status as a potential Grand Prize Winner confidential and not to disclose this to anyone except immediate family members and/or employers (provided they also agree not to disclose Nominee’s/Finalist’s status as a potential Grand Prize Winner), until such time as Sponsor publicly announces the Grand Prize Winners at the Award Ceremony. Nominees/Finalists agree that if their status as a potential Grand Prize Winner is disclosed by themselves, any immediate family members, or employers, Nominee/Finalist may be disqualified and, if disqualified, will forfeit the Grand Prize.
In the event a selected Grand Prize Winner is a resident of Alabama or Nebraska and under the age of nineteen (19), a parent or legal guardian may be required to also sign the Declaration in order for such winner to be qualified to receive their Grand Prize.
8. GENERAL: Subject to applicable law, each participant hereby expressly grants to the Contest Parties and their respective successors, assigns, sublicensees and designees, the irrevocable right to use and publish his/her name, Nomination details, likeness (photographic or simulated), voice, biography and place of residence for all purposes, including, without limitation, advertising, marketing, promotional and publicity purposes in connection with this Contest (“Advertising”), in any and all media now or hereafter devised, worldwide, in perpetuity, without any form of notice, permission or any amount or kind of compensation, except for the awarding of the prize(s). All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor and/or its licensors, and each Nominator/Nominee hereby disclaims and waives any claim of right to such Advertising. Such Advertising shall be solely under the control of Sponsor and/or its licensors, and each Finalist hereby waives any claim of control over the Advertising content as well as any possible claims of misuse Finalist’s name, likeness or voice under contract, tort or any other theory of law. The Contest Parties do not assume any responsibility for any disruption in the Contest, including, but not limited to, the failure or interruption of any website or any internet service provider. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Contest materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. In the event Sponsor is prevented from continuing with the Contest by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Contest or prize. Sponsor additionally reserves the right, in its sole and absolute discretion to modify, suspend or terminate the Contest should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Contest.
9. CONDUCT: The Contest Parties are not responsible for the actions of Nominators or Nominees in connection with the Contest, including Nominators’ or Nominees’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity, or proper conduct of the Contest. The Contest Parties reserve the right, at their sole discretion, to disqualify (or terminate the prize of) any individual if the individual is found to be, or suspected of, acting in any manner deemed by the Contest Parties to be in violation of the Official Rules, or to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person, or to be tampering with the entry or voting process or the operation of the Contest, and void all associated Nominations. CAUTION: ANY ATTEMPT BY A USER, YOU OR ANY OTHER INDIVIDUAL TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST PARTIES RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

WAIVERS AND DISCLAIMERS: The Contest Parties assume no responsibility or liability for: (a) lost, late, stolen, undelivered, inaccurate, incomplete, delayed, misdirected, damaged or garbled Nominations, URLs, or emails; (b) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of Nominations at any point in the operation of this Contest; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (e) inaccessibility or unavailability of the Internet or the Website or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Nominations, the announcement of the prizes, or in any other Contest-related materials; or (f) any injury or damage to Nominators/Nominees or to any other person's computer which may be related to or resulting from any attempt to participate in the Contest. If, for any reason, the Contest (or any part thereof) is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then the Contest Parties reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part. If terminated, the Contest Parties will award the prizes in a manner consistent with the judging process above from among all non-suspect, eligible Entries received for the Contest up to the time of such action.
11. RELEASES: All participants, as a condition of participation in this Contest, release, discharge, indemnify and hold harmless the Contest Parties and each of their respective directors, officers, employees, agents, successors and assigns (collectively, “Released Parties”) from and against any and all liability, claims, costs (including attorneys’ fees), losses, damages, fines, or actions of any kind whatsoever for injuries, death, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with: (i) participation in any aspect of the Contest (including travel to/from any Contest activity), (ii) the receipt, ownership, use or misuse of any prize awarded, including any travel associated with any prize, (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; (iv) Nominator/Nominee registration material on any related website, or (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Contest activity and/or prize.
12. GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Nominators/Nominees, Sponsor or the Released Parties in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
BY ENTERING THE CONTEST, NOMINATOR/NOMINEE AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY NOMINATOR/NOMINEE BE PERMITTED TO OBTAIN ANY AWARD FOR, AND NOMINATOR/NOMINEE HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) NOMINATOR’S/NOMINEE’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND NOMINATOR/NOMINEE IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
13. DISPUTE RESOLUTION: The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in the State of Ohio and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury, and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Contest shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in the State of Ohio. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in the State of Ohio. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of Nominator/Nominee to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
14. ENTRY INFORMATION AND CONTEST COMMUNICATIONS: As a condition of entering the Contest, each Nominator/Nominee gives consent for Sponsor to obtain and deliver his or her name, address, Nomination, and other information to third parties for the purpose of administering this Contest and to comply with applicable laws, regulations and rules. Any information Nominator/Nominee provides to Sponsor may be used to communicate with Nominee in relation to this Contest or on a Contest winner’s list. By participating in the Contest, Nominator/Nominee agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at https://www.ta-petro.com/privacy-policy/. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.
15. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules or the Declaration will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Declaration is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Nominators/Nominees agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
16. WINNERS LIST REQUEST: For a list of Finalists and Grand Prize winners, send a self-addressed, stamped envelope, for receipt by 5/27/27 to: Realtime Media LLC, Attn: 2027 Citizen Driver Contest (11530), Winners List, c/o Realtime Media, 2460 General Armistead Ave STE 209, West Norriton, PA 19403. Winners List will be sent out after the Award Ceremony.
